Licensed, or shared
100% Foreign Ownership in Kuwait
Full foreign ownership in Kuwait comes through a licence, and a published list of activities cannot have it at all.

The excluded list decides it first
The direct investment authority can license up to full foreign ownership, but a defined list of activities is excluded from the regime entirely — among them crude extraction, real estate brokerage, labour supply and recruitment, and certain security services. If your activity sits on that list, no amount of structuring produces full ownership, and the honest answer is a Kuwaiti partner or a different market.
- Your activity checked against the excluded list before anything else
- Both routes modelled, including the partner arrangement
- Direct answer where full ownership is simply unavailable
Mainland, free zone and offshore jurisdictions we file in — so the recommendation is based on your activity, not on which authority we happen to be registered with.

Where the limits are
Ownership by route
The activity decides which door is open.
| Route | Foreign ownership | Notes |
|---|---|---|
| Direct investment licence | Up to 100% | For approved activities and investors |
| Excluded activities | Not available under the regime | A published list, reviewed periodically |
| Default Companies Law route | Minority foreign share for most activities | Kuwaiti participation expected |
| Commercial agency | Kuwaiti agent required | Separate agency rules apply |
| GCC nationals | Treated differently | Both for ownership and for tax |
| Government contracting | Local arrangements often required | Tender rules apply separately |
The excluded activity list, licensing criteria and ownership rules are set by the authorities and change. Yours are checked against the current position before any application. Kuwait operates two parallel routes: the default Companies Law route, where most activities expect Kuwaiti participation, and a direct investment licence permitting up to full foreign ownership for approved activities and investors. Which applies to you governs almost everything else, and it is settled before any filing.
How it works
Establishing your ownership position
Excluded list, then eligibility, then route.
Check the excluded list
Whether your activity is capable of being licensed for foreign ownership at all. This is the first question, not a later one.
Test eligibility
Whether your group meets the authority’s criteria on track record, capability and contribution to the economy.
Choose and apply
The licence pursued where available, or a properly documented partner structure where it is not.

Questions
Kuwait foreign ownership — FAQs
Can a foreigner own 100% of a Kuwaiti company?
Through the direct investment licence, for approved activities and investors. The default company route generally expects Kuwaiti participation, and some activities are excluded from the licensing regime altogether.
Which activities are excluded?
A published list including crude extraction, real estate brokerage, labour supply and recruitment, and certain security activities. We check yours before you build any plan around full ownership.
What does the authority assess?
Your track record in the activity, financial standing, the technology or expertise you bring, and the contribution to the Kuwaiti economy including local employment. It is a substantive assessment.
Is a Kuwaiti partner always needed otherwise?
Under the default route, generally yes for most activities. The arrangement should be properly documented rather than informal.
Are GCC nationals treated the same as other foreigners?
No. GCC nationals are treated differently for both ownership and tax, so tell us early if a shareholder is a GCC national.
