Corporate Tax & Withholding Compliance in India

Withholding is everywhere

Corporate Tax & Withholding Compliance in India

Indian tax compliance is dominated not by the annual return but by withholding on almost every payment you make.

Tax deduction at source is the real workload

India requires tax to be deducted at source on a very wide range of payments — professional fees, contractor payments, rent, commission, interest and more — each with its own rate and threshold. The deducted amounts must be remitted and reported quarterly, and certificates issued to payees. Failure disallows your own expense deduction and attracts interest and penalties. It is the single largest compliance burden for an Indian company.

  • Withholding obligations mapped across your actual payment types
  • Quarterly returns and certificates handled on time
  • Concessional rate eligibility assessed properly

How it works

Getting tax right

Withholding first, because it is continuous.

01

Map the payments

Every category of payment you will make, matched to its withholding rate and threshold, so deduction happens at the time of payment.

02

Register and elect

Tax registrations completed and the corporate rate regime assessed against its conditions before the first return.

03

File the cycle

Withholding remittances and quarterly returns, advance tax instalments, and the annual return from audited accounts.

Questions

India corporate tax — FAQs

What is tax deduction at source?

An obligation to deduct tax when making a wide range of payments and remit it, with quarterly returns and certificates to payees. It is the dominant compliance workload here.

What happens if I fail to deduct?

Your own deduction for the expense can be disallowed, and interest and penalties apply. The cost of getting it wrong exceeds the amount involved.

Can my company use the concessional corporate rate?

Specified regimes offer lower rates subject to conditions, including forgoing certain deductions. We assess eligibility rather than assuming it.

What is advance tax?

Tax paid quarterly during the year on estimated income, with interest for shortfalls. Estimating it requires reasonable visibility of results.

Do related-party transactions need documentation?

Yes, transfer pricing documentation is required where related-party transactions exist, with its own filing. We flag the requirement and co-ordinate specialists.
