Trademark & Brand Registration in Kuwait

National filing, no shortcut

Trademark & Brand Registration in Kuwait

Kuwait cannot be reached through the international trademark system. Protection here means a national application.

GCC business setup specialists

There is no international shortcut into Kuwait

Brand owners who protect a portfolio through a single international application covering many countries find Kuwait is not among the destinations available to them. Protection here requires a national filing made directly, with its own power of attorney, legalisation and Arabic requirements. Portfolios managed centrally often have a Kuwait-shaped hole in them for exactly this reason.

  • The gap in international portfolios identified and closed
  • Arabic and Latin forms both addressed
  • Legalised power of attorney handled as part of the filing

How protection works here

Routes into Kuwait, and the one that does not exist

National filing is the route.

RouteAvailable for Kuwait?
National applicationYes — the route to use.
International application designating KuwaitNot available.
A neighbouring state’s registrationNo. Protection is national.
Arabic form of the markA separate filing consideration.
Multiple classesEach carries its own fee.
Power of attorneyRequired, and legalised.

Classification, examination, publication and opposition procedures are set by the registry and change, and the international registration system does not extend to Kuwait. Protection in neighbouring states requires separate filings.

How it works

From search to certificate

Nationally filed, properly documented.

01

Search and scope

The register searched for conflicts and classes identified for what you actually sell here.

02

Prepare and file

Legalised power of attorney obtained and the application filed nationally, in the forms of the mark you use.

03

Prosecute to registration

Examination answered, publication monitored and the opposition window seen through to certificate.

To file

What an application needs

The legalised power of attorney takes the longest.

Questions

Kuwait trademark registration — FAQs

Can I add Kuwait to my international trademark registration?

No. The international system does not extend to Kuwait, so protection here requires a national application. Centrally managed portfolios often have this gap.

Does a registration in a neighbouring Gulf state cover Kuwait?

No. Protection is national, and each state requires its own filing.

Should I register the Arabic form?

If you market in Arabic, yes. In practice the Arabic and Latin forms operate as separate marks.

What is the power of attorney for?

It authorises the filing on your behalf, and it must be legalised. Obtaining it is usually the slowest part of preparing the application.

Should I file before appointing a distributor?

Yes. Securing the mark in your own name before any commercial appointment avoids a dispute that is slow and expensive to unwind.
