Real Estate & Property in Kuwait

Ownership is not available

Real Estate & Property in Kuwait

Non-Kuwaitis generally cannot own real estate in Kuwait. This is one of the firmest restrictions in the region.

GCC business setup specialists

Lease, because you cannot buy

Kuwaiti law restricts ownership of real estate to Kuwaiti nationals, with limited provision for Gulf nationals under conditions. Foreign companies do not acquire land or buildings. On top of that, real estate brokerage sits on the list of activities excluded from the foreign investment regime, so operating as an agency is not available either. The practical answer for a foreign business is a commercial lease, properly structured.

  • The restriction stated plainly before you spend anything
  • Commercial leasing structured to support your licence
  • Honest that brokerage is not open to foreign investors

How it works

Securing premises instead

The lease has to support the licence.

01

Establish what is possible

Your ownership position stated plainly, and the leasing route set out as the practical alternative.

02

Match premises to the licence

A lease in the company name, in the right premises category for your registered activity, since the municipal licence depends on both.

03

Document and comply

Lease registered as required, licence obtained against it and renewal dates tracked alongside the lease term.

Before you commit

What we need to know

Activity and premises category must match.

Questions

Kuwait property for foreigners — FAQs

Can a foreign company buy an office in Kuwait?

No. Ownership of real estate by non-Kuwaitis is generally prohibited, and foreign companies do not acquire land or buildings.

Are Gulf nationals treated differently?

There is limited provision for Gulf nationals under conditions. If a shareholder is a Gulf national, tell us early because it can change the position.

Can I set up a real estate agency?

Real estate brokerage is on the list of activities excluded from the foreign investment regime, so it is not open to a foreign-owned business.

Does buying property give residency?

The question does not arise, since ownership is not available. Residency comes through employment and the manpower system.

What should I do instead?

Take a commercial lease in the company name, in a premises category matching your activity, because the municipal licence depends on both.
